The term “probate” refers to a court-supervised proceeding that may be required upon the death of a person. Probate is the mechanism by which ownership of land and other assets are transferred from the decedent to the decedent’s heirs when another mechanism, such as at trust, has not been utilized. Probate also deals with the payment of any debts and taxes.
